User Agreement

Website ANTICOPIRAT.RU — terms of use. This document regulates the relationship between the Website Owner and the User, contains the terms of access and use of the Site's functionality.

General provisions

This User Agreement of the website anticopirat.ru (hereinafter — «User Agreement» or «Agreement») regulates the relationship between the Individual Starikov Nikanor Vladimirovich TIN: 772824075040 — the administrator and owner of the website anticopirat.ru (hereinafter — «Owner»), providing an unlimited number of persons with the right to use the capabilities (functionality) of the Site in the ways provided by the Site, and the person using any of such capabilities (hereinafter — «User»), and also contains the terms of access and use of the Site ANTICOPIRAT.RU.

By using the Site ANTICOPIRAT.RU, the User confirms that they have read and expressed full consent (acceptance) with the terms of this Agreement without any modification or withdrawal.

Owner — Starikov Nikanor Vladimirovich, TIN 772824075040, registered as a payer of the Professional Income Tax (self-employed) in accordance with the established procedure.

1. Concepts and definitions

For the purposes of this Agreement, the following terms (if they are capitalized in the text of the Agreement) shall have the meanings specified below:

Authorization The set of actions of the User aimed at obtaining access to the Site in the scope and on the terms determined by the Owner, accompanied by the transfer from the User of information uniquely associated with the User ID and forming part of the User's Account. User Account The set of static and dynamic information regarding the User, uniquely identified by a unique natural number (User ID), including, but not limited to: login, password, full name, date of birth, passport data, residential address, phone number, email, legal entity name, OGRN, OGRNIP, registration date (in case of registration of a legal entity user or individual entrepreneur), etc., necessary for providing the User with access to the Site's services. The User is responsible for the accuracy and relevance of the part of the Account content determined by the User themselves, including the User's Personal Data. License Agreement A legal agreement on the provision of a License, concluded between the Owner and the User, defining along with this User Agreement the terms of use of the Site ANTICOPIRAT.RU and establishing the mutual rights and obligations of the parties. License Package A set of parameters for providing access to the Software, commercial terms of access to the Software established taking into account the Price and Tariffs, including the term of the License, the scope of rights granted, the functionality of the Software and the amount of remuneration. The content of License Packages is agreed by the Parties upon conclusion of the License Agreement. License The right to use the Software under a simple (non-exclusive) license in accordance with the License Package selected by the User. Personal Account A personalized Site interface with a set of user tools that allows managing the User Account, including entering, changing and deleting data that identifies the User or is otherwise related to them. Owner An individual — Starikov Nikanor Vladimirovich, who is the holder of exclusive rights to the Software and provides the User with access to the Site ANTICOPIRAT.RU under the terms of this User Agreement and the License Agreement. Intellectual Property Objects Protected by the current legislation of the Russian Federation, the results of intellectual activity and equated means of individualization, as they are specified and understood in the text of Article 1225 of the Civil Code of the Russian Federation. Personal Data Any information relating directly or indirectly to a specific or identifiable individual (personal data subject). User Any individual who has reached the age permissible in accordance with the legislation of the Russian Federation for acceptance of this User Agreement, has the appropriate authority, has free access to the Internet, is admitted in the manner determined by the Owner to use the Site, also any person registered on the Site and expressed the intention to use the Site ANTICOPIRAT.RU. A User may be a citizen carrying out entrepreneurial activities without forming a legal entity — an individual entrepreneur registered in accordance with the legislation of the Russian Federation and having legal capacity allowing them to be a subject of law. A User may be a representative of an individual entrepreneur, a legal entity or an individual acting on the basis of a power of attorney or on another legal basis. Regardless of the provision of relevant documents, the legal representatives of a person who has not reached the age of civil capacity are responsible for the fact of registration of such an individual as a User, as well as for access to the Site through the User Account. Site Visitor An Internet user who has visited the Site during a certain period of time and has unique User characteristics, but has not passed the Registration and Authorization procedure in the manner prescribed by this User Agreement, and has the opportunity to use the Site and its functionality only to the extent provided for unregistered users. Software A computer program called «AntiPirat 2.0», designed to solve problems related to the automatic detection of infringement of exclusive rights to Intellectual Property Objects in the form of their illegal placement on the Internet and subsequent provision of the possibility of taking measures for technical and legal protection of Intellectual Property Objects on the Internet. Equivalent names for this Software are: «STARGARDD - AntiPirat 2.0». Registration A set of actions aimed at obtaining access to the Site's services in the scope and on the terms determined by the Owner, accompanied by the transfer from the User of certain user information and the creation of a User Account. Site The site located on the Internet at: https://anticopirat.ru/, including the mobile version of the Site, mobile application, intranet and ftp server, as well as its subdomains and versions for other hardware platforms. Parties / Party The Owner and the User jointly or, respectively, separately. Price Financial terms specified in Russian rubles, determining the cost of the License depending on the volume (combination) of the Software's functionality available for the User to use during the selected and paid term of the License. Tariffs Financial terms specified in Russian rubles, determining the cost of the License depending on the volume (combination) of the Software's functionality available for the User to use during the selected and paid term of the License. Tariffs are posted and available for review on the Site in the «Tariffs» section. Electronic document transmitted via communication channels Information prepared, sent, received or stored using electronic, magnetic, optical or similar means, including information exchange in electronic form and email.
